PRIVACY POLICY KNOKKE-HEIST MUNICIPALITY AND PCSW

The municipality and the Public Centre for Social Welfare (PCSW - OCMW in Dutch) of Knokke-Heist (hereinafter referred to as ‘administrations’) use a lot of personal data relating to citizens, employees and partners. Personal data are mainly collected from citizens for the proper execution of legal, lawful and voluntary tasks. Citizens must be able to trust that the municipality and the PCSW will handle their personal data carefully and securely.    Both administrations are moving with the times.  New technological developments, innovative facilities, globalisation and an increasingly digital government make other demands on the protection of data and privacy. The administrations are aware of this and ensure that privacy is safeguarded, for example through measures linked to information security, data minimisation, transparency and user control.

Administration and management play a crucial role in safeguarding privacy.   By means of this policy, the municipality and the PCSW of Knokke-Heist give a clear direction in terms of privacy issues and show that they guarantee, protect and maintain users’ privacy.  This policy applies to the entire organisation, and to all processes, components, objects and data collections of both administrations.  This privacy policy is in line with the general policy of the municipality and the PCSW, as well as the relevant local, regional, national and European laws and regulations.

LEGAL FRAMEWORKS FOR DATA HANDLING

The municipality and the PCSW are responsible for drawing up, implementing and enforcing the policy.
To this end, the following legal framework applies: European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data, better known as the GDPR.

BASIC PRINCIPLES

The municipality and the PCSW handle personal data in a safe manner and respect the privacy of those involved. Both administrations abide by the following principles:

LAWFULNESS, FAIRNESS AND TRANSPARENCY

Personal data are processed in accordance with the law and in a proper and careful way.

BASIS AND PURPOSE

The municipality and the PCSW ensure that personal data are only collected and processed for well-defined, explicit and legitimate purposes.  Personal data are only processed with a justifiable basis.

DATA MINIMISATION

The municipality and the PCSW only process the minimum amount of personal data that are necessary for the purpose determined in advance. Both administrations strive for minimal data processing.   Where possible, less or no personal data are processed.

RETENTION PERIOD

Personal data are not stored for longer than necessary. The storage of personal data may be necessary for the proper execution of tasks or to comply with legal obligations.

INTEGRITY AND CONFIDENTIALITY

The municipality and the PCSW handle personal data with care and keep them confidential. Personal data are only processed by persons who are sworn to secrecy and for the purpose for which they were collected.    In doing so, the administrations ensure appropriate security measures are in place for the handling of personal data. These measures are detailed in the information security policy.

SHARING OF DATA WITH THIRD PARTIES

In the event of cooperation with external parties involving the processing of personal data, both authorities make agreements about the requirements that the data exchange must meet. These agreements are in accordance with the legal requirements.   The municipality and the PCSW regularly check these agreements.

SUBSIDIARITY

In achieving the purpose for which the personal data are processed, the infringement on the privacy of the persons concerned is limited as much as possible.

PROPORTIONALITY

The infringement on the interests of the persons concerned may not be disproportionate in relation to the purpose of the data processing.

RIGHTS OF THE DATA SUBJECTS

The municipality and the PCSW respect all your rights as a data subject.  You can take note of the personal data we process about you and the use we make of these data.  You may correct, supplement or delete these data, or restrict the processing of your personal data by sending an e-mail to privacy [at] knokke-heist.be or by phoning (+32) (0)50 630 315. You have the right to lodge a complaint about the processing of your personal data to the Data Protection Authority, Drukpersstraat 35, 1000 Brussels (www.privacycommission.be)

This privacy policy shall enter into force once it has been adopted by the municipal executive and the PCSW council.    The policy is regularly evaluated and revised if necessary.  Any amendments to this policy are announced via www.knokke-heist.be.
